These terms govern the sale of dietary supplement products by MICRO-EQUILIBRE SAS, 15 rue de Buthegnemont, 54000 Nancy, France.

The orders

Orders can be placed online at www.microequilibre.fr, by phone call at +33 (0)3 83 33 38 52 or with a purchase order sent in by postal mail.

On the website www.microequilibre.fr, all orders need to be linked to a customer account. During the first order, the customer will be required to provide all the necessary information in order to create an online account. The customer can then modify his shopping cart by deleting or adding on new products until he finally decides to validate his order. Before proceeding to payment, the customer will have to accept the general terms and conditions of sale. The seller will send a confirmation of the recorded order by electronic mail.

Prices

The prices indicated are in Euros and inclusive of VAT (all taxes included) taking into account the VAT applicable on the day of the order.

The seller reserves the right to change his prices at any time, understanding however that the price listed in the catalog on the day of the order will be the only one applicable.

Payment terms

Payments are made through a reliable and secure credit card payment system (Bleue, Visa, Eurocard, Mastercard). The transaction is secure (SSL encryption). No confidential payment data is stored by Microequilibre. The user may also opt to pay for his purchases by means of a cheque made out to SAS MICRO-EQUILIBRE and sent to Microequilibre, 15 rue de Buthegnemont, 54000 Nancy, France.

Microequilibre retains full ownership of the purchased items until full payment has been made by the customer.

Delivery

Standard delivery costs are 3.50 Euros, including VAT, in metropolitan France. Cost of delivery to a specific pick-up point are 4,00 Euros, including VAT. Pick-up at Microequilibre headquarters is free. Delivery is also free of charge in continental France for purchases starting from 60 euros, all taxes included. For other destinations, please contact us.

The standard shipping method is provided by the carrier GLS, delivered with a required signature. We shall provide you with a link that will enable you to track the delivery of your package online. For metropolitan France, the delivery time is 2 to 3 working days. For other destinations, delivery times range from 3 to 15 working days.

During shipping, transportation risks will be borne by Microequilibre. Deliveries to post-office boxes are not possible. The products will be shipped to the delivery address indicated during the ordering process. However, if absent, the products can be delivered to a pick-up point, the carrier will then notify the buyer by leaving a notice in the mailbox.

In the event the maximum delivery period exceeds 30 days, the buyer can exercise his right to terminate the order.

Legal warranties and after-sales service

The legal warranty of conformity is based on Article L. 211-4 up to L. 211-14 of the Consumer Code and on Article 1641 of the Civil Code pertaining to identified defects.

Cases of non-conformity appearing within twenty-four months after the delivery of the item are presumed to have existed at the time of delivery. In the event of lack of conformity, the buyer will choose between repair and replacement of the item, considering the value of the item as stipulated in Article L.211-9 of the Consumer Code.

The legal warranty of conformity exists independently and in addition to the warranty provided in the sales contract. Microequilibre is held accountable for defects found. In the event that a Microequilibre product should have a defect, the consumer has the choice of terminating the sales contract or reducing the purchase price (article 1641, 1644 of the civil code). In order to assert his right of warranty, the buyer should notify Microequilibre, indicate his name and address, the order number and a short description of the defect found. If Microequilibre so wishes, the buyer will be asked to send back the defective item for verification, at the risk and expense of Microequilibre, to the following address:

Retractation

THE RIGHT TO RETRACT

You have the right to withdraw from this contract within fourteen days without giving any reason.

The cooling-off period expires fourteen days after the day on which you, or a third party other than the carrier and who is designated by you, takes physical possession of the item.

of your decision to withdraw from this contract by means of an unambiguous declaration (for instance, a letter sent in by postal mail or an electronic mail). You can use the model withdrawal form but this is not obligatory.

You can use the model withdrawal form available in the appendix of this document.

For the withdrawal period to be respected, it is sufficient for you to transmit your statement invoking your right to retract before the withdrawal period expires.

EFFECTS OF RETRACTION

In the event of your withdrawal from this contract, we will refund all payments received from you, including delivery charges (with the exception of additional charges arising from the fact that you have chosen, if applicable, a delivery other than the less expensive standard delivery method suggested by us) without undue delay and, in any event, no later than fourteen days starting from the day we were informed of your decision to withdraw from this contract. We will refund you using the same means of payment that you used for the original transaction, unless you expressly arrange otherwise; in any case, this refund will not bring about any costs for you. We may defer repayment until we have received the item or until you have provided proof of shipment of the item, whichever date is the earliest.

You must send back or return the item in person to Microequilibre, 15 rue de Buthegnemont, 54000 Nancy, France, without undue delay and, in any event, no later than fourteen days after you communicate to us your decision to withdraw from the contract. We will consider this time period duly respected if you return the item before the fourteen-day period has expired. You will be responsible for the direct costs of returning the item.

The customer will only be liable for any diminished value of the item resulting from the handling other than what is necessary to ascertain the nature, the characteristics and functioning of this item.

Partial non-validity

The invalidity of one of the clauses found in this contract, notably by applying a law, a regulation or heeding a court decision, will not result in the invalidity of these terms and conditions.

Settlement of disputes

The terms and conditions of sale are subject to French law. In case of dispute, the client will remain free to call upon a third-party mediator or go-between with the aim of reaching an amicable settlement of the dispute. In the absence of an amicable settlement, the dispute will be brought before the competent French court of law.
